1. Acceptance of Conditions
For the safety and wellbeing of all entrants, and of the event, all entrants must accept and comply with New Zealand Law and all Lake Taupo Cycle Challenge Event Terms and Conditions.
1.1 I acknowledge and accept, that participating in the Lake Taupo Cycle Challenge involves the risk of injury, illness and in extreme cases, loss of life. I accept all risks involved in taking part in this event
1.2 I acknowledge that all roads remain open for this event and that road rules apply at ALL times during the event.
1.3 I recognise that key hazards and risks of the event include, but are not limited to, vehicles, other riders, my bicycle, my own riding, pedestrians, spectators, road surface, track surfaces, weather, poor physical preparation, improper protective gear, hypothermia and heat stroke.
1.4 I accept that certain incidents or an emergency may take place in the lead up to or during the event, including, but not limited to, adverse weather, volcanic eruption, earthquake, flood, landslide, pandemic (eg Covid–19), major road accident etc.
1.5 In the event of an incident or emergency, I agree to follow the instructions of event staff. If I see an emergency, I will contact the Event Operations Centre. If I need assistance, but cannot get hold of Event Operations Centre, I will call NZ emergency services by dialling 111
1.6 I accept that it is my responsibility to contact the event organisers should any information on my entry form need to be updated e.g. emergency contact details.
1.7 I acknowledge that the bib and sticker set and mountain bike plate are for my use only and I will not pass these on to any other rider.
1.8 I acknowledge that photo ID will be required at event registration as proof of ID.

2. Legal Issues
2.1. If I am involved in an accident I will not seek to blame or make a claim against the organisers or assist anyone else in making a claim.
2.2. I will release the organisers, their officers, volunteers, employees, sponsors or any party associated with the event of any liability, financial or otherwise, for any direct or indirect loss, injury or death which might be sustained from any intended or actual participation in this event or its related activities.
2.3. Any legal action related to the event will be taken in New Zealand courts under New Zealand law.
2.4. By agreeing to these Terms and Conditions of entry you agree you are not excluded from personal liability of participants for collisions caused by yourself or another rider.

3. Withdrawal, Transfer, Category Change, Cancellation and Refund Policy
3.1. In the event of a change of route or dissatisfaction, the organisers are under no obligation to provide any refund, either in part or full.
3.2. If you need to withdraw from the event, no refunds, or transfers to future events, will be offered. While not mandatory, we would recommend you take advantage of the XCover option when making your event entry
3.3 You can transfer your entry to another rider at no additional cost up until midnight 31 October 2024. After this time there will be a $30 administration charge.
3.4. You can change your event category up until midnight 31 October 2024 at no charge. Any changes after this time will incur an administration fee of $20. An additional cost will also apply if you are changing to an event category with a higher entry price.
3.5 If the event cannot take place for any reason, including but not limited to Force Majeure (eg. an act of god, adverse weather, volcanic eruption, earthquake, flood, landslide, pandemic (including Covid–19), a major road accident or the like, there will be no refunds either in part or full. In good faith however, the event will do its utmost to return to entrants any unspent monies minus the event’s unrecoverable costs.

4. Safety
4.1. I agree to abide by the NZ Road code at all times. In particular, when on the road, I will stay to the left of the centre line and ride towards the far left side of the road. I understand that I do not have right of way over other traffic. When my slow speed impairs traffic I will as soon as practicable move as far left as possible to allow following traffic to pass.
4.2 I understand that briefings, signage, and course marshals are a service to me but are not a guarantee of safety
4.3. I will ride carefully and with due regard to the safety of other cyclists and other road users. I will ride single file where there are double lines, keep a safe distance between riders, move off the road before dismounting, and use clear hand signals. When walking the bike I will keep well off the road and walk in single file.
4.4 I accept that despite the best efforts of the organisers to make the event as safe as they can, the organisers cannot control every circumstance.
4.5 I will not use a personal communication device whilst riding, e.g. cell phones or music devices.
4.6. I agree to notify the organisers if withdrawing from the event for any reason either prior to or during the event.
4.7 I understand that towing is not allowed
4.8 I understand that no aero/tri bars are to be used in this event when riding in bunches.
4.9 I acknowledge that although the event has medical personnel and resources at various points along the course, there will be a delay in medical assistance reaching me. I agree to allow medical staff to treat me as they see fit.
4.10 Cut off times - Management reserves the right to remove riders from the course if it’s apparent they will not arrive at the SH41 / SH1 intersection in Turangi by 4:00pm or complete the event by 8pm, or it is deemed the safety of themselves or others could be compromised.

5. Disqualification from the Event
5.1. Any entrant who, in the opinion of the organisers, fails to comply with the event terms and conditions and is seen to be breaking the NZ road rules at any time may be disqualified from the event. Disqualification will result in the offender’s name being completely removed from the event results and prize draw and may result in a refusal by the event organisers, to accept entry to future Lake Taupo Cycle Challenge events. No refund will be granted.
5.2. The organiser reserves the right to refuse any person’s entry, or cancel any person’s entry, up to the day before the Lake Taupo Cycle Challenge. In that event the person’s entry fee will be refunded.

6. Route Variation
6.1. The organisers of the Lake Taupo Cycle Challenge reserve the right to vary the route of any of the event categories without notice, should any situation requiring such action arise.

7. Expected Behaviour
7.1. The Lake Taupo Cycle Challenge is a communal event, and as such it is expected that entrants will conduct themselves in a manner which reflects well upon themselves and the event. It is expected that entrants will show respect towards all event officials, other riders and road users.
7.2. Riders must be drug and alcohol free whilst taking part in this event. No athlete that is currently serving a ban for an anti-doping rule violation may enter this event.
7.3 There is to be no littering.

8. Signing on behalf of others
8.1 If you are completing this entry on behalf of others e.g. team members, or on behalf of minors, then you must have them read these Terms and Conditions and obtain their permission (also in the case of a minor, their caregiver) to complete this entry on their behalf. By agreeing to the below Declaration and accepting these Terms and Conditions, you will be deemed to be also making it on behalf of those persons and with their authority and they will be bound by these Terms and Conditions as if they had personally agreed to the Declaration.
8.2 It is a requirement of the Lake Taupo Cycle Challenge that all participants U18 have received permission from their parent or caregiver to participate. The parent or caregiver must take full responsibility of their entry. This permission certifies that the entrant is capable of completing the entered event and is aware of all safety requirements and the terms and conditions outlined in this document.
8.3 These terms and conditions are binding on entrants’ relatives, personal representatives, heirs and successors.

9. Event Information
9.1. The event organisers publish a number of documents, which are available on the event website. The organisers will make every effort to ensure that each entrant receives all relevant information, but does not guarantee that each individual will receive all relevant information. It is each entrant’s responsibility to be informed and read all information made available.
9.2 The Lake Taupo Cycle Challenge collects and stores entrants details including postal address, email address and phone number. Entrants agree that these may be used to contact them regarding the event.
9.3 All entrants give permission to LTCC to use their name and images taken during the event, in the media and for marketing purposes.
9.4 All entrants understand and accept that their details will be added to the LTCC event database and they will be contacted from time to time in regards to upcoming events and promotions, by us or our event partners.
9.5 All entrants understand and accept that their details may be used for Contact tracing. LTCC will keep this information for as long as necessary or legally required to ensure compliance with the Government’s rules and health measures under COVID 19 security alerts. LTCC will only share this information with the Ministry of Health, District Health Board or any other government agency including Police if necessary or legally required. LTCC will only use this information for the purpose it was collected for, being compliance with the Government’s rules and health measures under COVID 19 security alerts. You can request access to your personal information and correction of it at any time.
9.6 A complimentary free alcoholic beverage may be available at the finish line for over 18’s. Entrants understand that no one under 18 will be served and they may be asked for ID
9.7 All entrants agree that their name, bib number, age group category and race results will be available to the public once they register.

10. Accompanying Vehicles
10.1. Accompanying and or support vehicles are not permitted on the course for any event category on the day of the Lake Taupo Cycle Challenge.

11. Preparation and Training
11.1. It is each entrant’s responsibility to ensure that they have adequately prepared themselves physically for their selected event. Entrants must note any medical conditions on their online registration and take any necessary medication with them. Entrants should seek medical advice if they have any health issues or doubts about their health.
11.2. It is the entrant’s responsibility to ensure that their bicycle, helmet and any other equipment used in the event are in road-worthy condition. Helmets must be worn at all times.

12. Event Care of Your Bicycle and Equipment
12.1. It is the responsibility of all entrants to arrange personal insurance to cover any potential damage, theft or loss of bikes and equipment while participating in the event.
12.2. The organisers of the Lake Taupo Cycle Challenge will take all care in handling riders’ bikes and associated equipment. Any damage caused by event personnel must be reported to Event Information for consideration on the day of the event.
12.3. The legal liability of the Lake Taupo Cycle Challenge for any damage to any Length of the Lake riders’ bike and/or equipment (only whilst being transported) is the limit as per New Zealand Law under the Contract and Commercial Law Act 2017 (previously the Carriage of Goods Act), which is $2,000 per unit and any claims will be limited to this amount only.

13. Charges for parts supplied by event bike mechanics
13.1 Bike mechanics are located around the course to provide emergency repairs and service. The service supplied by the bike mechanic is free of charge, but entrants agree that any parts used will be invoiced to the entrant post event.

14. Electric Bikes.
14.1 Electric bikes are permitted as part of the event in certain categories and will be timed separately from the non-assisted bikes. We will not supply charging stations around the course. Please make sure to select the correct category when completing your online entry. All e-bikes must be pedal assistance and be a maximum of 300 watts.

15. Prizes
15.1. To win a major prize, an entrant must be present at the event village at the time of the main prizegiving and fulfil the requirements as set out in the event literature. Lakesider entrants are not eligible for major prizes.
15.2. All major prize winners must give proof of their identity and will be required to sign for the prize.
5.3. All prize values are estimated in NZD dollars and include Goods and Service Tax, (if applicable)

16. Terms of Merchandise Sales
16.1 By placing an order you are offering to purchase a product/s and/or service/s and will be subject to our terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure events for which we will not be responsible. In order to order merchandise with Lake Taupo Cycle Challenge you must be over 18 years of age and possess a valid credit or debit card. Where a contract is made between yourself and a third party the contract will be subject to their terms of sale. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.
16.2 Payment of Merchandise. Upon receiving your order, your credit or debit card will be charged for the full amount of the purchase.

17. Transferred Entries
17.1 These terms and conditions apply to any registration or entry that may have been transferred from a previous year.

DECLARATION I accept and agree to abide by all the above event terms and conditions (also available from our website www.cyclechallenge.com or by request from us). I have read and understand the safety information regarding this event and understand that I participate in this event at my own risk. I hereby attest and verify that I am physically fit and have sufficiently trained for and reviewed the course descriptions of the event I have chosen to enter. I understand that NZ road rules apply at all times and that no roads are closed for this event. I indemnify the Lake Taupo Cycle Challenge from any obligation or claims related to the event whether or not it is specifically noted within the events Terms and Conditions.
